Lindsay Clancy is returning to a Massachusetts court on Tuesday, nearly one month after the judge declared a mistrial in the high-profile murder case.
The defense plans to ask Judge William Sullivan to investigate the lone holdout juror over his alleged cellphone use, which is prohibited during trial and jury deliberations. Other jurors suggested he used his phone during the deliberations, which lasted for seven days.
Michael Desronvil was the lone juror who voted to convict Clancy, who was charged with murdering her three children. After the jury was sent back multiple times by the judge to continue deliberations and reach a consensus to no avail, a mistrial was eventually declared. As a result, no verdict was handed down.
Kevin Reddington, the lead defense attorney for Clancy, previously filed a motion asking the judge to consider looking into Desronvil’s alleged cellphone use. Reddington is prepared to bring up the motion, alongside others, in court Tuesday morning.
Clancy’s lawyers are also seeking to dismiss the murder charges for killing her three young children. Additionally, they asked the judge to enter a not-guilty verdict, finding the defendant not guilty because, in their view, the state’s prosecutors presented insufficient evidence at trial.
It is unclear whether prosecutors plan to retry Clancy, who remains in custody at a psychiatric hospital. Next steps in the case will presumably be determined at the upcoming court hearing, which started at 9 a.m. Tuesday.
Clancy did not dispute killing her three children in January 2023, but her attorneys argued she should not be held criminally responsible because she suffered from postpartum psychosis at the time. Her youngest child was 8 months old when killed.
Desronvil said he has no doubt in his mind as to whether Clancy committed the murders.
Clancy’s lawyers have tried to discredit the holdout juror by bringing up his past. They requested court documents from a criminal charge against Desronvil in 2021, when his wife told police that he had grabbed her by the throat and threw her against a dresser. The criminal charge was later dismissed.
Defamation lawyer Edward Paltzik, who represents Desronvil, has criticized Reddington for unfairly attacking the holdout juror.

“Kevin Reddington is just upset that he lost out on his legacy moment,” Paltzik said in an interview with Fox News host Kayleigh McEnany. “He was one vote away from winning a trial that would have been the capstone of his career and he didn’t get it, and he lost his mind because of it.”
In a video statement to Fox News’s Sean Hannity, Desronvil said he wanted to “reel everything back and put the focus on the three angels,” referring to the three killed children.
