Georgia Attorney General Chris Carr has appealed Fulton County Superior Court Judge Robert McBurney’s ruling that struck down the state’s “heartbeat” abortion law.
Carr, a Republican, is asking Georgia’s Supreme Court to reinstate the six-week abortion ban while the court reviews the state’s appeal.
McBurney ruled Monday that the abortion ban Georgia put in place immediately following the overturn of Roe v. Wade in 2022 violates women’s rights to privacy and liberty under the state’s constitution.
Carr’s appeal goes straight to the state’s highest court due to the challenge of the abortion laws’ constitutionality.
Prior to the overturning of Roe v. Wade, Georgia allowed abortions until fetal viability, which is roughly 22 to 24 weeks of pregnancy. McBurney’s decision Monday temporarily reinstated that prior law.
