President Donald Trump has restored Title IX to its proper role in education, but it will always remain one Democratic president away from being sabotaged once again.
The Department of Education reversed the changes to Title IX adopted by the Biden administration, which had been blocked by the courts. The Trump administration has returned Title IX to where Trump left it in 2020. Then-President Joe Biden had tried to use Title IX to impose transgender ideology on schools across the nation, reinterpreting Title IX’s sex protections to apply to “gender identity” in an attempt to block Republican-run states from keeping boys and men out of women’s and girls’ sports and spaces.
That was a new wrinkle, given how quickly transgender ideology took over the Democratic Party. But Biden also brought back a destructive relic of the Obama administration, erasing due process protections from Title IX and subjecting students’ educational futures to the whims of university administrators. Former President Barack Obama and Biden had altered Title IX instructions to reduce the standard of evidence needed for universities to brand students as rapists and sabotaged due process elements (such as cross-examination).

The result was over 150 students winning lawsuits against universities that had branded them as rapists and permanently altered the course of their lives under Obama’s version of Title IX. Biden attempted to bring that back, subjecting 20-year-old students to possibly ruinous university hearings under which Biden himself would be declared a rapist. All of this was done with the stroke of a pen, with one man attempting (Biden) and another successfully (Obama) rewriting Title IX for the entire country.
The next Democratic president will (attempt to) do the same. The erasure of due process protections remains a top Democratic goal because it interferes with prosecuting the perpetually debunked “rape culture” on college campuses. At the whims of transgender activists, the next Democrat will attempt to do what Biden did and force girls sports and locker rooms to be open to boys. Democrats will continue to attempt to brute-force these Title IX rewrites until the makeup of the courts is favorable to them, cementing them in place in all defiance of what Title IX is meant to protect.
