Jan. 6 committee withdraws Trump subpoena

The House committee investigating the Jan. 6 Capitol riot withdrew its subpoena of former President Donald Trump on Wednesday.

Committee Chairman Bennie Thompson (D-MS) announced the withdrawal of the committee’s subpoena, which was issued in October, as the committee’s investigation winds down.

“In light of the imminent end of our investigation, the Select Committee can no longer pursue the specific information covered by the subpoena,” Thompson said in a letter to Trump’s attorney that was obtained by CNN. “Therefore, through this letter, I hereby formally withdraw the subpoena issued to former President Trump, and notify you that he is no longer obligated to comply or produce records in response to said subpoena.”

The committee had subpoenaed the former president for testimony and documents related to its investigation into the riot on Jan. 6, 2021, when hundreds, possibly thousands of Trump supporters descended onto Capitol Hill to try and illegally stop the certification of the results of the 2020 presidential election. However, Trump responded by filing a lawsuit to block the subpoena earlier this year. The committee previously dropped other subpoenas related to the investigation.

Trump responded to the committee’s drop of the subpoena in a Truth Social post Wednesday night, claiming they had probably done so “because they knew I did nothing wrong, or they were about to lose in Court … In any event, the Subpoena is dead!”

The end to the subpoena came shortly after the select committee issued its final report, in which it made criminal referrals to the Department of Justice against Trump.

The referrals recommended charges of “conspiracy to make a false statement,” “conspiracy to defraud the United States,” “inciting or aiding an insurrection,” and “obstruction of an official proceeding” against the former president. However, the referrals are more symbolic, unless the Justice Department decides to bring any charges.
