The man who photographed himself on Jan. 6 with a photo from Rep. Nancy Pelosi’s (D-CA) office was sentenced to four years in prison on Friday.

U.S. District Judge Beryl Howell sentenced Kevin James Lyons, 40, to 51 months in prison on six charges, one felony and five misdemeanors, for his participation and actions during the Capitol riot. Lyons would go on to take a photo of the late Rep. John Lewis and a wallet from a staffer’s jacket pocket.

The photo of Lyons with the stolen property was not posted to social media, but was texted to friends instead. Lyons accompanied the photo message with the caption: “I took this off Pelosi’s f***ing desk!! We f***ing did it!!”

“I’m pretty confident I am now a multiple Federal felon,” Lyons texted minutes later.

FBI agents were able to identify Lyons by Jan. 8, 2021, on account of a photo of a map of Washington, D.C., that he posted to his Instagram. He captioned the photo: “I refuse to tell my children that I sat back and did nothing. I am heading to DC to STOP THE STEAL!”

According to court documents, Lyons admitted that the post was only online for an hour before he deleted it. He then attempted to tell the FBI agents who had arrived to interrogate him at his Chicago home, that they had no proof he was the one who posted the photo.
