Donald Trump’s lawyer and spokeswoman Alina Habba delivered a statement outside the Miami courthouse where the former president was arraigned Tuesday, calling the indictment politically motivated.

“The people in charge of this country do not love America — they hate Donald Trump,” Habba said as protesters chanted in the background. “What we are witnessing today is the blatant and unapologetic weaponization of the criminal justice system.”

Trump pleaded not guilty to the charges brought on by federal prosecutors on Tuesday afternoon.

Multiple Republican lawmakers and affiliates have accused the Department of Justice of hypocrisy concerning the cases politicians face for handling classified documents.

Habba called out Hillary Clinton and President Joe Biden for not being prosecuted despite also retaining possession of classified documents, saying, “None of them came into possession of those documents while they were president.”

Former Vice President Mike Pence was cleared this month in a federal investigation into the classified documents found at his Indiana home. Biden’s investigation is ongoing for confidential documents discovered in his Washington, D.C., office and Delaware residence.

“The decision to pursue charges against President Trump while turning a blind eye to others is emblematic of the corruption we have here,” Habba said.

Habba said the 37 charges brought against Trump by special counsel Jack Smith’s investigation were part of a political weaponization of the justice system, highlighting the indictment came less than a year and a half before the 2024 presidential election.

Habba said the indictment of Trump “should terrify all citizens of this country.”

Smith, assigned by Attorney General Merrick Garland to lead two investigations into Trump, briefly spoke to the public last week, saying the nation has “one set of laws, and they apply to everyone.”

Habba compared the indictment of the current GOP front-runner to “the type of thing you see in dictatorships like Cuba and Venezuela.”

“These are not the ideals that our democracy is founded upon,” Habba concluded. “This is not our America.”
