Education Department ends Biden-era gender ideology settlements with schools

The Department of Education announced Monday it will terminate settlements with five school districts and one college that were brokered during the Biden administration to instill gender ideology at the institutions.

Assistant Secretary for Civil Rights Kimberly Richey said in a statement Monday that the Department of Education was “removing the unnecessary and unlawful burdens” that it claimed the Biden administration imposed “in its relentless pursuit of a radical transgender agenda.”

“While previous Administrations launched Title IX investigations based on ‘misgendering,’ the Trump administration is investigating allegations of girls and women being injured by men on their sports team or feeling violated by men in their intimate spaces,” Richey said

“Today is yet another demonstration of the Trump administration’s commitment to uphold the law, protect our students, and restore common sense. No longer will the federal government force educational institutions to violate the law or punish them for upholding it,” the statement continued.

The Education Department under the Biden administration had attempted to include “gender identity” in its definition of Title IX, which was originally passed in 1972, and it reached settlements with various schools to follow its revised definition, which was rejected by a federal court in January 2025 and then axed by the Trump administration shortly after taking office.

The Trump administration announced it would not enforce the agreements the Biden administration brokered with Cape Henlopen School District, Delaware Valley School District, Fife School District, La Mesa-Spring Valley School District, Sacramento City Unified, and Taft College.

Since returning to the White House last year, President Donald Trump’s administration has moved to rid the federal government of gender ideology and other initiatives pushed by LGBT activists, including allowing men who identify as women into female sports. The administration has also gone after schools that have pushed gender ideology in violation of Title IX and other civil rights laws.

The Trump administration has backed efforts in a pair of lawsuits before the Supreme Court this term that are aiming to uphold state laws banning men from women’s sports, including by arguing that Title IX requires men to be barred from women’s sports. The Supreme Court is expected to rule on the pair of lawsuits over laws barring men from women’s sports in the coming weeks.
