Elon Musk‘s political action committee is being sued for allegedly failing to pay registered swing state voters as he promised to in return for signing petitions or referring others for the 2024 election.
The lawsuit comes after the Tesla mogul-turned-presidential adviser dropped over a quarter of a billion dollars to secure a GOP victory in November, using payments to individual voters as a motivating factor to get them to the polls.
America PAC promised $47 and eventually $100 to voters in the seven battleground states for signing a petition to support the Constitution. However, three Pennsylvania, Nevada, and Georgia residents claim that the PAC breached the contract by failing to pay them in full.
The federal class action lawsuit, filed on May 8, per Reuters, would represent everyone who signed or referred a voter to the petition and did not receive the full payment.
Musk, who spearheaded the Department of Government Efficiency and operates in an adviser role to President Donald Trump, has done similar giveaways, including a $1 million daily payment to those who signed a pledge supporting freedom of speech and the right to bear arms.
He also offered $100 to registered Wisconsin voters to sign a petition “in opposition of activist judges” during the state’s Supreme Court election. Despite the $25 million infusion from the billionaire, liberal candidate Susan Crawford defeated Musk-backed Brad Schimel by 10 points in April.
The Wisconsin race was Trump’s first test with swing-state voters following a flurry of executive actions that raised concerns in red and blue districts alike over the fate of Medicaid and Social Security. Since the 2024 election, Democrats have flipped GOP-controlled offices in several state special election contests, most recently in Omaha, where a Democrat defeated the Republican mayoral incumbent.
Musk topped the list of Republican donors for 2024, donating $291 million to GOP candidates, political action committees, and outside spending groups. Shortly after Election Day, he promised that his America PAC would “play a significant role in primaries” in the 2026 midterm elections, in which House Republicans are defending a razor-thin majority.

He’s also pledged to back challengers to GOP lawmakers who push back against Trump’s agenda.
America PAC declined to comment.
