Freshman Rep. Robert Garcia (D-CA) introduced a privileged resolution to expel embattled Rep. George Santos (R-NY) from Congress following him being charged with 13 felonies.

Because this is a privileged resolution, it must be scheduled for a vote within two days, meaning it will be on the House floor by Thursday. But House Republicans can offer up a motion to table the resolution, and it wouldn’t get a full vote.

“He should be expelled from Congress,” Garcia told reporters. “It’s very clear that he’s a liar, he’s a fraud, and besides the 13 counts that just happened, which are all very serious, it’s important to note that he’s already admitted to criminal activity, to actual fraud, in Brazil.”

When asked why not wait until after the convictions to file the motion because Santos is presumed innocent until proven guilty, Garcia said the New York Republican has already admitted to lying about his resume, which he believes is grounds for the expulsion.

In addition to Garcia’s resolution, a number of Republicans have called on Santos to resign, including all of his fellow New York GOP freshmen. In addition, Rep. Tony Gonzales (R-TX) called on Congress to expel Santos after his criminal charges earlier this month.

“This is going to put, particularly those folks in New York, freshman colleagues of mine, on the record and see if they believe that someone that has admitted to defrauding and lying should continue to serve in Congress,” Garcia said. “I think they’ve made it public, and they certainly made it to me, that they believe he should resign. They don’t believe he should be in Congress. There’s been some members of Congress that have actually publicly said they might even vote to expel him.”

Garcia said he did not run this by any of his Republican colleagues but that he hopes they will support it. The resolution does have the support of Democratic leadership, he said.

“It’s past time for New Yorkers to have the honest representation they deserve,” Democratic Congressional Campaign Committee Chairwoman Suzan DelBene (D-WA) said in a statement. “Now is the time for Members of Congress to demonstrate where they stand and expel George Santos from Congress.”

Santos pleaded not guilty to the 13 charges earlier this month. He has also admitted to lying about most of his resume when running for office.
