Man charged with indecent exposure and who broke woman’s leg given probation by liberal DA

A Texas man who was convicted after he caused a woman’s leg to shatter in four places and reportedly touched himself inappropriately received no prison time due to the actions of a liberal district attorney.
Antonio Rios, 36, was sentenced to 10 years probation following a conviction on the charge of aggravated assault causing serious bodily injury, according to a report.

The decision to give Rios, who is also facing indecent exposure charges, was the product of Travis County District Attorney Jose Garza.
Garza was elected on a platform of criminal justice reform.
In the past, Garza has worked to eliminate cash bail for people charged with nonviolent, low-level crimes, pushed for diversion programs, and did not prosecute certain “low-level” drug offenses, according to the report.
Lynn Isaak, the woman Rios attacked in 2021, blasted his sentence as soft.
Isaak was jogging in her neighborhood when Rios attacked, she said.
For 7 miles, Rios chased her before she tried to fight him off, according to Isaak.
Rios touched himself as she attempted to escape before a neighbor finally scared him off, she said.
“It just shows how truly vicious the attack was,” Isaak said. “He really looked at me like I was his prey.”
The incident left her leg broken in four places, and she was unable to walk for four months, the report noted.
“My expectation was that he would have prison time according to the Travis County sentencing guidelines,” Isaak said. “We felt confident that with the evidence that exists on these cases, that if taken to a trial, a jury would have found him guilty.”
Rios has a reported history of indecent exposure in front of others, including a 9-year-old boy, but that case has not come to trial.
Kelsey McKay, Isaak’s attorney, ripped Garza because he promised to protect women while running for office.
“In my experience, I haven’t felt a lot of justice coming towards victims,” McKay said of Garza’s office. “His focus seems to be on not making the perpetrator worse.”
The fact that Garza released Rios without a GPS-monitoring device is evidence, she said.

“He doesn’t have a GPS on anymore,” McKay said. “It’s not a matter of time — it’s a matter of if he gets caught.”
“It’s not like one day, you’re like, ‘I’m going to go masturbate over a fire hydrant and scare a woman.’ You have developed that proclivity, you escalate, you need more.”
