Biden administration files emergency motion asking Supreme Court to restore availability of abortion drug

The Biden administration filed an emergency application asking the Supreme Court to reverse a Texas judge’s ruling, in order to restore access to an abortion drug.

The application is notable as being the first major abortion-related case to reach the court since the overturning of Roe v. Wade in June. The restriction of mifepristone, a drug commonly used for abortions, has caused a legal storm, with Democrats and the Biden administration pledging to do everything in their power to restore full access.

In the application filed by the Biden administration, the ruling restricting the drug was bashed as doing away with “scientific judgment.”

“The district court countermanded a scientific judgment F.D.A. has maintained across five administrations; nullified the approval of a drug that has been safely used by millions of Americans over more than two decades; and upset reliance interests in a health care system that depends on the availability of mifepristone as an alternative to surgical abortion for women who choose to lawfully terminate their early pregnancies,” it read, the New York Times reported.

Danco Laboratories, L.L.C, the manufacturer of the drug, also petitioned the Supreme Court, asking for a stay of preliminary injunction.
