DOJ seeks ’emergency relief’ over abortion pill restrictions at Supreme Court

FILE – This June 30, 2014 file photo shows the Supreme Court in Washington. Supreme Court justices found more common ground than usual this year, and nowhere was their unanimity more surprising than in ruling that police must get a judge’s approval before searching cellphones of people they’ve arrested. But the conservative-liberal divide was still evident in other cases, including this week’s ruling on religion, birth control and the health care law. The Justice Department plans to ask the Supreme Court to intervene after an appeals court froze part of a Texas judge’s order that would have suspended that government authorization of abortion drug mifepristone.

The U.S. Court of Appeals for the 5th Circuit only partially granted the DOJ and the drug manufacturer’s request to put U.S. District Judge Matthew Kacsmaryk’s ruling on hold, with access to the drug still limited. Attorney General Merrick Garland issued a statement condemning the appeals court decision.

WHAT CAN THE SUPREME COURT DOBBS DECISION TELLS US ABOUT THE ABORTION PILL CHALLENGE?

“The Justice Department strongly disagrees with the Fifth Circuit’s decision in Alliance for Hippocratic Medicine v. FDA to deny in part our request for a stay pending appeal. We will be seeking emergency relief from the Supreme Court to defend the FDA’s scientific judgment and protect Americans’ access to safe and effective reproductive care,” Garland said.”

This is a developing story and will be updated.
