Trump 2020 ally John Eastman faces disbarment in California

Conservative attorney John Eastman is facing disbarment in California. He was among the Trump brain trust concocting plans to challenge the 2020 election.

State bar regulators in California filed for disciplinary action against Eastman on Thursday. They accused him of undermining democracy by formulating legal strategies to overturn the presidential election in favor of former President Donald Trump.

Eastman is facing 11 counts of alleged ethics violations and false statements about the election.

“There is nothing more sacrosanct to our American democracy than free and fair elections and the peaceful transfer of power,” State Bar of California’s Chief Trial Counsel George Cardona said in a statement.

“The Notice of Disciplinary Charges alleges that Mr. Eastman violated this duty in furtherance of an attempt to usurp the will of the American people and overturn election results.”

Cardona’s office revealed that it was investigating Eastman in March.

Eastman has also weathered scrutiny from the Jan. 6 committee, Fulton County election inquiry, and Justice Department for his role in hatching plans to upend the election.

Perhaps most notably, Eastman wrote a two-page memo laying out an ambitious strategy for then-Vice President Mike Pence to decertify the election results. He also appeared to strategize ways for Trump’s team to use an alternative slate of electors so that Trump’s team could try to tip the election to him on Jan. 6.

Ultimately, the gambit failed. A group of rioters ransacked the Capitol, and Pence refused to capitulate. The state bar took note of Eastman’s memo and alleged that he made “false and misleading statements” about election fraud.

“The NDC alleges that, after hearing from the U.S. Department of Justice that it had not seen any election fraud on a scale that could have affected the election’s outcome, and after multiple courts had rejected election fraud lawsuits, Eastman knew, or should have known, that the factual premise for his proposals ― that massive fraud was at play ― was false, and that Trump had lost his bid for re-election,” the State Bar of California declared.

Now that the State Bar of California has filed the complaint against Eastman, the matter will head to the State Bar Court of California, which will ultimately rule on it.

Eastman was one of a handful of lawyers involved in Trump’s 2020 election machinations. Former Trump lawyer Rudy Giuliani recently had his law license suspended temporarily by a panel in Washington, D.C., which had raised similar concerns to the ones mentioned against Eastman.
