The retrial began on Monday for Mark Jensen, a man who has been twice convicted in the death of his wife in 1998.

The Wisconsin Supreme Court ruled in March 2021 that evidence used in Jensen’s conviction could not be used during a trial, according to Fox 6 News. He is accused of killing his wife, Julie Jensen, with antifreeze.

The evidence involved a letter and a voicemail received by a police officer in which Julie Jensen expressed fear that her husband was trying to kill her. In a letter, she wrote that police should look at her husband should something happen to her.

However, the state Supreme Court ruled that the statements cannot be used during the trial. Jensen has maintained his innocence in his wife’s death and stated that she was depressed and, after framing him, killed herself.

His case has been through several stages over the last decade. He has been under a sentence of life without parole after being convicted in 2008. In 2013, a federal court overturned his conviction and ruled Jensen either be retried or released from prison. A second prosecution began in 2017, and his conviction was reinstated without a trial. However, in March 2021, the judge ruled for a new trial.
