Key witness in Fani Willis trial ordered to return to stand after closed-door meeting with judge

A judge ordered Nathan Wade’s former law partner and divorce attorney Terrence Bradley to retake the stand to testify about the relationship between Wade and Fulton County District Attorney Fani Willis.  

Bradley originally tried to remove himself from testifying any knowledge of the relationship based on claims of attorney-client privilege. Fulton County Superior Court Judge Scott McAfee, who is overseeing this case, determined that some of Wade’s communications did not cover him under attorney-client privilege after a closed-door meeting on Monday.

“The Court believes that the interested parties did not meet their burden of establishing that the communication(s) are covered by attorney-client privilege and therefore the hearing can resume as to Mr. Bradley’s examination,” an email from McAfee said, according to CNN.

Bradley is expected to testify in the emergency hearing at 2 p.m. on Tuesday. 

Bradley is seen as the key witness for Trump’s defense attorneys seeking to oust Willis from the case. The attorney for Mike Roman, a Trump co-defendant and former Trump campaign official, is looking to hear more from Bradley about Willis’s and Wade’s claims about their personal relationship timeline. Roman’s defense attorney claims Bradley has personal knowledge that the romantic relationship began before Willis appointed Wade as special prosecutor to lead the case against Trump in 2021.

“Bradley has non-privileged, personal knowledge that the romantic relationship between Wade and Willis began prior to Willis being sworn as the district attorney for Fulton County, Georgia in January 2021,” according to a previous court filing from Ashleigh Merchant, Roman’s attorney. “Thus, Bradley can confirm that Willis contracted with Wade after Wade and Willis began a romantic relationship, thus rebutting Wade’s claim in his affidavit that they did not start dating until 2022.”

Willis and Wade have both testified under oath that their relationship did not start before Wade’s appointment to the case. 

Closing arguments for the motion to disqualify Willis from the case on the basis of her relationship are still scheduled for Friday. McAfee will then issue a decision on the motion to disqualify.
