The absurdity of transgenderism is that an all-women’s college will happily accept men, so long as those men simply say they are women, even if it means jeopardizing exemptions under Title IX.
The Department of Education is investigating Smith College, a women-only college, for violating Title IX. Title IX prohibits sexual discrimination, but it does allow single-sex institutions, such as Smith College, to receive federal funding.
However, Smith College is no longer a women-only college, as, in 2015, the university changed its admissions policy to allow transgender women. The university website reads that it “considers for admission any applicants who self-identify as women; cis, trans, and nonbinary women are eligible to apply to Smith.”

Ignoring the fiction that is “nonbinary” (and the contradiction that is “nonbinary women”), the acceptance of “transgender women” means that Smith College accepts men. That is because transgender women are men. That means Smith College has been accepting men, giving them access to what are supposed to be women-only bathrooms, locker rooms, and dorms, and allowing them to participate in women’s sports.
It should not need to be said that a women’s college cannot accept some men and still claim to be a women-only college, yet Smith College has made that a necessity. The university will now almost surely try to drag this legal fight out until 2029, when it will hope that a Democratic president takes office, since Democrats don’t believe in its central conceit that men and women are fundamentally different.
The California State University system is currently doing the same thing, suing the Department of Education after it identified violations by San Jose State University. San Jose State had allowed a biological male to play on the women’s volleyball team and use the women’s facilities.
EDUCATION DEPARTMENT ENDS BIDEN-ERA GENDER IDEOLOGY SETTLEMENTS WITH SCHOOLS
This is the risk universities are taking in their ideological pursuit of normalizing transgender policy. Smith College abandoned its women-only designation, willingly accepting the possibility of a legal battle with the Trump administration, in hopes that a future Kamala Harris, Gavin Newsom, or Alexandria Ocasio-Cortez administration will rule that the university has a right to pick and choose what aspects of Title IX it wants to follow. The CSU system is doing the same thing because higher education has been almost fully captured by the ideological zealots who claim that men can become women whenever they want.
This shows that Smith College and the CSU system simply do not care about Title IX protections. They are willing to violate Title IX based on warped left-wing interpretations of the law, temporarily risking it in hopes that Democrats will bail them out eventually, all to push the ball forward for the anti-science transgender movement that controls the American Left.
