The Department of Homeland Security is investigating embattled Rep. Eric Swalwell (D-CA) over allegations that he kept his family’s Brazilian nanny employed in the United States after her temporary visa expired.
A New York Post report on Saturday detailed two recent complaints against Swalwell over his hiring of the nanny in 2021 to look after his three children. One, filed to the Labor Department last week, claimed Swalwell and his wife lied to officials shortly before the nanny’s au pair visa expired to keep her in the U.S. The second alleged Swalwell paid the nanny with campaign funds during a two-year span when she no longer had proper work authorization and was in the country illegally.
DHS confirmed on Sunday that Swalwell is now under investigation after U.S. Citizenship and Immigration Services referred the case to the agency.
“No one is above the law, including a member of Congress,” DHS posted on X in announcing the inquiry.
The investigation is the latest blow to Swalwell, who has faced multiple sexual assault allegations in the past week, including from a former staffer.
The allegations have imperiled his California gubernatorial campaign and potentially his time in Congress.
Top Democrats have called for him to drop his bid for the governor’s mansion and resign from the House.
He is also facing a looming expulsion effort from Rep. Anna Paulina Luna (R-FL), who vowed to file the motion earlier this weekend.

One of the misconduct allegations has led to an inquiry from the Manhattan district attorney’s office as well.
Despite the mounting scrutiny, Swalwell has vowed to “fight” the allegations, calling them “flat false” and politically motivated as the California gubernatorial primary is less than two months away.
